01General Conditions & Eligibility

• Age Requirement: By using this Application, you represent and warrant that you are at least 13 years of age (or 16 years of age in the UK/EEA). If you are under the age of majority in your jurisdiction, you must review these Terms with your parent or legal guardian to ensure they understand and agree to them.
• Account Responsibility: You are responsible for maintaining the security of your device and any activity conducted through your installation of the App.

02Services & AI Generation Disclaimer

• AI Video Generation: The Application provides AI-powered tools that process text prompts, images, photos, and video inputs to generate synthetic AI video content ("Generated Content").
• Nature of Output: AI generation is an automated process. Outputs are generated based on probabilistic algorithms and may occasionally produce unpredictable, inaccurate, or offensive content. We make no guarantees regarding the accuracy, quality, uniqueness, or suitability of the Generated Content for any specific purpose.

03User Content & Conduct Rules

• Ownership of Inputs: You retain ownership of all original text prompts, photos, and media uploaded by you to the Application ("User Inputs").
• License to Process: By submitting User Inputs, you grant us a worldwide, non-exclusive, royalty-free, limited license to process, host, transform, and stream your User Inputs strictly for the purpose of generating AI content and delivering the Services to you.

Acceptable Use & Prohibited Content

You agree that you will NOT upload inputs or generate video content that contains, promotes, or facilitates:

• Nudity, sexually explicit, pornographic, or suggestive content.
• Violence, hate speech, harassment, bullying, discrimination, or illegal activities.
• Deepfakes or unauthorized impersonation: Generating non-consensual realistic images or videos of living individuals, celebrities, public figures, or minors without explicit authorization.
• Copyright or Trademark Infringement: Uploading images, branding, or logos that you do not own or have full legal authorization to use.
• Malware, automated abuse, or security tampering: Reverse-engineering, scraping, or attempting to extract the underlying AI models or API code.

Content Moderation: We reserve the right to review, block, filter, or delete any User Inputs or Generated Content that violate these Terms or applicable laws.

04Ownership & Intellectual Property Rights

• Application Rights: All software, design, logos, trademarks, and underlying technology of the Application are the exclusive intellectual property of KIDDIO TOYS LTD and its licensors.
• Rights to Generated Content: Subject to your compliance with these Terms, you are granted the right to use, view, download, and share the Generated Content for your personal or lawful commercial purposes, provided that you comply with all applicable copyright and intellectual property laws in your jurisdiction.

05In-App Purchases, Credits, & Auto-Renewable Subscriptions

Google Play Billing: All in-app purchases, digital credits, and auto-renewable subscriptions are processed exclusively through Google Play Store Billing Services (Google LLC).

Auto-Renewal

• Payment will be charged to your Google Play Account upon confirmation of purchase.
• Subscriptions automatically renew unless auto-renew is turned off or cancelled at least 24 hours before the end of the current subscription period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of your chosen plan.

Cancellation: You can manage or cancel auto-renewable subscriptions at any time via your Google Play Account Settings. Cancelling a subscription prevents future charges but does not refund the current billing period.

Refund Policy: All purchases and credit consumables are handled directly by Google Play Store. Refunds are subject to Google Play’s Refund Policies. Except as required by mandatory law or Google Play rules, all fees paid are non-refundable.

06Third-Party Services & Cloud Processors

The Application may interact with third-party hosting, payment processing, or AI cloud infrastructure providers (such as Google Cloud). Your interactions with third-party software or service providers are governed by their respective terms and privacy policies. We are not responsible or liable for any third-party services.

07Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APPLICATION AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

08Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL KIDDIO TOYS LTD, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your access to or use of (or inability to access or use) the Service;
• Any AI-generated content obtained from the Application;
• Unauthorized access or alteration of your transmissions or data.

IN ALL CASES, OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF £50 GBP OR THE AMOUNT YOU PAID TO US IN THE PAST SIX (6) MONTHS.

09Indemnification

You agree to defend, indemnify, and hold harmless KIDDIO TOYS LTD, its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debts (including legal fees) arising from:

• Your violation of these Terms;
• Your violation of any third-party right, including copyright, trademark, privacy, or publicity rights;
• Any User Input or Generated Content submitted by you that causes harm or violates third-party rights.

10Governing Law & Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them or their subject matter shall be governed by and construed in accordance with the laws of England and Wales.

Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts of London, United Kingdom, provided that consumers in the European Union or other jurisdictions may retain mandatory consumer protection rights under their local laws.

11Changes to Terms

We reserve the right to modify or update these Terms at any time. We will notify users of any material changes by updating the "Last Updated" date at the top of these Terms or displaying an in-app notice. Continued use of the Application after any such changes constitutes your acceptance of the new Terms.
